Terms of Service

1. Acceptance of Terms

By accessing or using FretGenius on any platform, including our iOS and Android apps, our websites, and our web checkout (the "Service"), provided by FretGenius ("we," "us," or "our"), you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old, or the minimum age required where you live, to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian, who must agree to these Terms and is responsible for any purchases.

3. Description of Service

FretGenius helps you learn the guitar fretboard. The Service includes guided learning paths (such as Note Path and Interval Path), lessons, scored practice modes, Daily Coach practice plans, progress feedback, tuner tools, microphone-based trainers, practice reminders, and reference tools. Available features may depend on your platform, device, language, instrument and tuning settings, and subscription status, and may change over time.

4. Pseudonymous Accounts

You do not need a username and password to use FretGenius. We create a pseudonymous account for your device so we can save and sync your progress, as described in our Privacy Policy. Because your account is tied to your device and app installation, we may not be able to recover your progress if you change devices, reset your device, or delete the app. You can restore eligible purchases through the app store account that made them.

5. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Service on devices you own or control, solely for your personal, non-commercial educational purposes. If you downloaded our iOS app from the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies to your use of the app.

6. Restrictions on Use

You agree not to:

  • Copy, modify, distribute, sell, lease, or create derivative works based on the Service or any part of it.
  • Reverse engineer, decompile, or disassemble the Service, or attempt to discover its source code, except where applicable law permits it despite this restriction.
  • Use the Service for any illegal or unauthorized purpose.
  • Attempt to gain unauthorized access to our systems or networks.
  • Circumvent or tamper with subscription checks, purchase verification, free-trial eligibility, or other access controls.
  • Use automated means (such as bots or scrapers) to access the Service or extract its content, except for standard search engine indexing of our public websites.
  • Remove, obscure, or alter any proprietary notices (including copyright and trademark notices) on the Service.
  • Use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with other people's use of it.

7. Intellectual Property Rights

The Service, including its visual interfaces, graphics, illustrations, characters, animations, design, lessons and other educational content, sounds, software, and all other elements of the Service ("Materials"), is protected by intellectual property and other laws. All Materials are the property of FretGenius or our licensors. Except as expressly authorized in these Terms, you may not use the Materials. We reserve all rights not expressly granted in these Terms.

8. Feedback

If you send us ideas, suggestions, or other feedback about the Service, you allow us to use it without restriction or compensation to you. Please do not include sensitive personal information in feedback or support messages.

9. Paid Subscriptions (FretGenius Pro)

Certain features are available only with an active FretGenius Pro subscription. Subscriptions may be purchased through Apple App Store or Google Play in-app purchase or, where available, through our web checkout, which is operated by RevenueCat with payments processed by Stripe.

Purchase terms. The price, billing period, and any free trial or introductory offer are shown to you before you buy, in the app, store, or web checkout. These Terms and our Privacy Policy form part of those purchase terms. Prices may vary by country and may include or exclude taxes depending on where you live.

Automatic renewal. Subscriptions renew automatically at the then-current price for the same billing period unless you cancel before the end of the current period. For App Store and Google Play subscriptions, you must cancel at least 24 hours before the period ends, or as otherwise required by the store, to avoid being charged for the next period.

Free trials and introductory offers. If your plan includes a free trial or introductory price, it automatically converts to a paid subscription at the regular price when the trial or introductory period ends, unless you cancel before then. Trial and offer eligibility is determined by us and the applicable store, and is generally limited to one per person or store account. Any reminder we send before a trial ends is a courtesy; you are responsible for cancelling in time if you do not want to continue.

Managing and cancelling. You can manage or cancel an App Store or Google Play subscription in your store account settings and, where available, from the subscription screen in the app. You can manage or cancel a web subscription using the link in your purchase confirmation email or the RevenueCat customer portal. If you cannot access that link, contact support. Cancelling stops future renewals; you keep access until the end of the period you have paid for.

Refunds. If you would like a refund, contact us at support@fretgenius.app and we will help. App Store purchases can only be refunded by Apple under its policies, so for those we will help you request a refund from Apple. This does not affect any refund rights you have under applicable law.

Promotional offers and codes. Offers, discounts, and promotional codes are subject to the conditions stated with them, have no cash value, and may be withdrawn or changed at any time before you redeem them.

Changes. We may change subscription features, eligibility, or pricing. Price changes for an existing subscription will be communicated in advance as required by applicable law and the rules of the store or payment provider, and you can cancel before the change takes effect.

10. Microphone Features and Permissions

Some features require microphone permission (for example, the tuner and microphone-based trainers). If you deny or revoke microphone permission, those features may be unavailable. Microphone-based results may be affected by your device, environment, and instrument and may not always be accurate.

11. Daily Coach and AI-Generated Content

Daily Coach practice plans and their messages are generated with the help of artificial intelligence based on your practice statistics. AI-generated content may be inaccurate, incomplete, or not suited to you. It is provided for practice guidance only, and you should use your own judgment when following it.

12. Third-Party Services

The Service relies on third-party providers, as described in our Privacy Policy. Your use of third-party services, such as the App Store, Google Play, or a payment provider, is also governed by their own terms and policies.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WHILE WE STRIVE FOR ACCURACY IN MUSIC THEORY CONTENT, LESSONS, AND FEEDBACK, WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, ERROR-FREE, OR UNINTERRUPTED. WE DO NOT GUARANTEE THAT USING THE SERVICE WILL RESULT IN MASTERY OF ANY INSTRUMENT OR MUSICAL CONCEPT. YOU USE THE SERVICE AT YOUR OWN RISK.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FRETGENIUS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (c) ANY CONTENT OBTAINED FROM THE SERVICE; OR (d) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF FRETGENIUS EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICE GIVING RISE TO THE CLAIM.

15. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless FretGenius and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your misuse of the Service or your violation of these Terms.

16. Your Statutory Rights

Nothing in these Terms limits or excludes any rights you have under consumer protection or other laws that cannot be waived or limited by contract, including any rights you may have to withdraw from a purchase. Where the law of your country does not allow a limitation or exclusion in these Terms, that limitation or exclusion applies only to the extent the law allows.

17. Changes to Terms

We may modify these Terms from time to time. If we make changes, we will post the revised Terms on this page and update the "Effective Date" above, and for material changes we may also notify you within the Service. Your continued use of the Service after the revised Terms take effect means you accept them. If you do not agree to the revised Terms, stop using the Service and cancel any subscription.

18. Termination

We may suspend or terminate your access to the Service if you breach these Terms, if required by law, or if we discontinue the Service. If we discontinue the Service for reasons other than your breach, we will give reasonable notice where possible. You may stop using the Service at any time by uninstalling the app, and you can cancel any subscription as described in Section 9. Sections 6, 7, 8, 9 (as to amounts owed), 13, 14, 15, 16, and any other provisions that by their nature should survive termination will survive termination.
